2022年3月，国家药监局颁布《人工智能医疗器械注册审查指导原则》，对人工智能医疗器械类型进行界定，并对人工智能医疗器械生存周期过程，包括需求分析、数据收集、算法设计、验证确认、更新控制等环节做出了规定，并提供了16类技术考量因素，对AI医疗器械划定完成进一步规范，同年9月，上海市第十五届人民代表大会常务委员会第四十四次会议通过《上海市促进人工智能产业发展条例》并于10月1日实施，作为人工智能领域首部省级地方性法规，鼓励AI医疗发展。
